In your letter of the 8th September, you mention the high cost of insertions in the Gazettes. Is there here another minor economy to be effected? I understand that the text of Letters Patent is repeated verbatim in each Gazette. Is this necessary? For example, would it be good enough, in our case, if the entry were on these lines:

“Letters Patent appointing A., B and C as Counsellors of State were issued under the Great Seal on … September 1980”?

Thank you for your letter of the 4th September about Letters Patent appointing Counsellors of State.

I confirm that the sealed Letters Patent for this purpose which you send us are not issued to anybody but are simply kept in a cupboard here. They are therefore as you say in a class of their own and I entirely support your suggestion that they should in future be produced in a more economical form.

It is quite stimulating to find the extent to which, under current pressures, one can save money by cutting out time-honoured practices for which, on enquiry, there proves to be little or no justification! I have myself already identified several such practices here, notably in regard to the appallingly expensive business of publication in the Gazettes.

Yours ever,

LETTERS PATENT

It has been suggested to me that we ought to reconsider the practice whereby Letters Patent appointing Counsellors of State are engrossed on vellum and have the Great Seal affixed to them.

The point is that each time this is done, it costs about £390. The procedure, as you know, is for a Warrant to be typed on good quality paper, to be submitted for the Queen’s signature and, when the Warrant duly signed is returned, the Letters Patent are engrossed on vellum at a cost of £15 a sheet, and subsequently put in a leather pouch which costs £10; the engrossing fee is £50. When the Letters Patent have passed the Great Seal, notice of that fact is reported in the three Gazettes at a cost of £95 for each insertion. As I understand it, the Letters Patent are then sent to you and remain in the Privy Council Office until, presumably, the time comes for them to be sent to the Public Record Office.

The suggestion is that we could make a minor economy by substituting, for engrossment on vellum, typescript on good quality paper and by using the Wafer Seal. This suggestion may well be worth pursuing if (as I believe to be the case) the Letters Patent are never publicly exhibited or sent to (or retained by) any of the Counsellors of State named in them. On that assumption, they seem to fall into a quite different category from Letters Patent creating a peerage, appointing to a great office of State, or embodying a Royal Charter – each of which is cherished and proudly exhibited by its recipients.

However, before I take the matter any further, I would be grateful for your views.

Documents which receive the Great Seal

The majority of the documents prepared in the Crown Office bear the wafer Great Seal and are typed on good quality paper.

The following documents receive the pendant Great Seal and are written on vellum.

1. Life peerages
2. Lords of Appeal in Ordinary
3. Heads of Division
4. Lord Chief Justice, Northern Ireland
5. Lords Justices
6. High Court Judges
7. Attorney-General
8. Solicitor-General
9. Lord-Lieutenants
10. Bishops (Royal Assent only)
11. Counsellors of State
12. Power (to members of the Royal Family) to confer Knighthoods
13. Great Seal Commissions
15. [sic] A few other documents which are required very infrequently (e.g. Grant of the Title of Lord Mayor)

One single sheet of vellum now costs £15-00.

Counsellors of State are required frequently when The Queen leaves the country, whether for a short or long period. For instance Letters Patent were written on vellum for The Queen's recent visit to Switzerland and were again for her brief visit to Australia. Three sheets of vellum are needed for each of the completed documents. The fee payable to Mrs. Patricia Westmacott for engrossing is £50. When the document is completed it is put into a leather pouch, which costs about £10. Notice of the passing of the Letters Patent is reported in the London, Edinburgh and Belfast Gazettes. The Stationery Office now charge £95 for each

Page 2

insertion. Total costs are approximately £390. The method of preparing Letters Patent for Counsellors of State is not affected by Crown Office rRules.

Could a small saving be made if these documents were typed on best quality paper and wafer sealed? I think it is important that notice of the issue of Letters Patent should be reported in each of the three Gazettes.

The completed documents are delivered to the Privy Council Office for safekeeping: so far as I know they are not referred to again.

You may however consider that these documents are of some constitutional importance and that a small saving in the cost of production would not be justified.

<text>Crown Office Procedure Sheet for the Letters Patent appointing Lord Belstead as Lord Privy Seal.

This allowed Crown Office staff to record the various steps involved in preparing the patent. For example, it notes that Downing Street instructed the Crown Office to prepare the Warrant on January 11, 1988, and then the Warrant was sent to the Privy Council Office by special arrangement on January 12. The PCO returned it to the Crown Office on January 19, and the Lord Chancellor countersigned the Warrant in addition to recepi'ing that same day.

The sheet also records details about the patent such as the fact that it was typed on a small sheet of loan paper and the use of the Great Seal was authorized by a Warrant. The document was wafer sealed and transmitted to Lord Belstead in a red pouch.

The sheet records other formalities such as the entries in the Patent Roll and Docquet Book and the sending of a notice to the Gazette. Interestingly, it also notes some interaction with the publishers of Who's Who and Dod's Parliamentary Companion.</text>
