PRIME MINISTER

NEXT BISHOP OF LIVERPOOL

The Archbishop of York rang me yesterday to ask if I could give any indication of your likely attitude to the results of the Crown Appointments Commission’s names for Liverpool.

I told him that at first sight you did not see the names of Reid and Cassidy as being an adequate choice, given the importance of the Liverpool appointment and the stature achieved by the outgoing Bishop. I added that you would be evaluating both names and, as is your right, the possibility of asking the CAC to meet again to produce further names.

This did not faze the Archbishop. He said that he is making up his mind as to what to recommend in the letter that he will write to you in the next few days reporting the outcome of the CAC.

I have, of course, been reflecting further after our conversation. I do not think that I could recommend that you should go for Reid: he just does not measure up to the requirement or to the job description provided to the CAC by the diocese, and he would be nearly 64 when he took over. I judge that the Archbishop of York shares this view. Cassidy is a more problematical choice. The Archbishop of York – who knew him in London – is uncertain about his judgment and “bottom”, especially for such a senior bishopric, but he would be energetic and care for his diocese. One argument for going for him is that George Carey could not take exception to your

Page 2

preferring him to Reid: you will remember that with 7 votes for Reid and 5 for Cassidy you have every right to go for the latter.

But I am increasingly attracted by going for a return to the CAC for new names. George Carey said to me last week: “the new Prime Minister wouldn’t want to flex his muscles this early, would be?” But that is not the point. As I see it, it is not a matter of your flexing your muscles, but of pointing out to the CAC, as I tried to do during its meeting, that the candidates offered do not measure up to what you and the diocese require. As the person who would have to explain this to the CAC I would be prepared to go through with asking it to resume its work, if that is what you wish.

For the moment you need do nothing until the letter from the Archbishop of York is received. Then it may be appropriate for you to talk to David Hope on the phone before you take a final decision.

PRIME MINISTER

Diocese of Liverpool

I. Candidates provided by the Crown Appointments Commission

Rt Rev Gavin Reid (63 last month) Bishop of Maidstone (in the Canterbury Dicoese) since 1992. Out-and-out evangelical: leads the Churches’ work on the Millennium. “His public pronouncements occasionally lack judgement”. Little parish experience and at his age he could retire in less than two years time;

Archdeacon George Cassidy (55 this year) Archdeacon of London and Canon of St. Paul’s since 1987. An Ulsterman and originally a NI Civil Servant. Of evangelical origins he’s now middle of road. A tough and fair administrator – too tough for some. Wide range of social contacts outside Church. Energetic, with good mind, but some lack of “bottom”.

The CAC gave 7 votes to Reid and 5 to Cassidy – effectively “no preference” and thus the choice for you is open.

II. Options

All the following are legitimately open to you:

to go for Reid:

to go for Cassidy:

to ask for more names.

Page 2

Pros & Cons

George Carey wants Reid, one of his suffragans, to be appointed. But it is not his patch – Liverpool is in the Northern Province and David Hope has yet to make up his mind on his advice to you. Previously Reid has not been thought to be up to a diocesan job, so why is he now at 63? Answer: The diocesan reps on the CAC made a pitch for him, which G Carey backed.

George Cassidy would be energetic and get round the diocese: (David Sheppard has been too much identified with Liverpool city). He’s also intelligent and, after some misgivings, supports the ordination of women. Can be a little narrow on social issues, but has learnt to be more measured and tolerant as he has experienced the difficulties of London. But is he really big enough to be Bishop of Liverpool?

Asking for more names is a bit risky, on two grounds. One is that an extra name that might come forward is that of Canon David Gillett, another evangelical and Principal of the Church’s Bristol theological college. He’s not up to the Liverpool job: so far he’s been thought of as good enough for a suffragan post only. On the other hand you might get as a second additional name one of the two really good suffragans who could do the job – Langrish of Birkenhead and Stevens of Dunwich. The other risk is that George Carey might cut up rough at the results of the CAC and Reid being put to one side, even though, as I say, the appointment is not in his Province.

Subject to what David Hope says I would go for option 2, ie Cassidy.

(Sgd.) John

John Holroyd

IN THE COURT OF THE VICAR-GENERAL OF
THE PROVINCE OF CANTERBURY

Re: The Confirmation of the Election
to the See of London

______________
Judgment
______________

In this application the Reverend Stephen Holland, minister of the Westhoughton Evangelical Church and a member of the Protestant Truth Society, seeks to oppose the confirmation of the election of the Right Reverend Sarah Mullally, Bishop of Crediton, to the vacant see of London. Mr Holland has responded to citation served upon him by lodging Particulars of Objection dated 1 March 20018 and appearing before me in chambers on 5 March 2018.

The first matter arising from his application is whether Mr Holland has locus standi; in other words whether he has sufficient interest in the proceedings to stand as an opposer. The question received consideration in Rex v. Archbishop of Canterbury [1902] 2 KB 503 at 523, where the allegation of want of interest was not pursued by counsel for the bishop-elect because a decision on the merits was sought. It is clear, however, from the observation of Lord Alverstone CJ that lack of sufficient interest would be decisive in a case such as the present.

In normal circumstances the minister of a Church not in communion with the Church of England, and who is not resident in the diocese concerned, would lack sufficient interest to oppose the election. On this occasion, however, special citation was directed to Mr Holland. It would be unfair to deprive him of the opportunity to put his case in response to such citation. On that ground alone I have permitted him to address me on the merits.

Mr Holland's basic proposition is that the assumption by a woman of the role of leadership in the Church is contrary to Scripture and Tradition. In support of his submissions he has drawn attention to several passages from the Epistles, most notably Saint Paul’s well-known words in 1 Corinthians chapter 11 verse 3 and chapter 14 verses 33-36. As regards the tradition of the Church, Mr Holland has relied upon quotations from the early writers and upon the decisions of the Councils concerning the limited role of women. Against this background he has contended that the Church of England, in permitting the ministry of women, has erroneously been led by the ‘spirit of the age’ instead of adhering to the guidance of the Holy Spirit. The confirmation of the election of a diocesan bishop is a legal process. It is governed by the applicable law. This is now: to be found in the Bishops and Priests (Consecration and Ordination of Women) Measure 2014 which

Page 2

authorised the General Synod to legislate by Canon so as to enable women to be consecrated as bishops. Under such authority Canon C2.1 was amended to provide that

“A man or a woman may be consecrated to the office of bishop.”

The relationship between the Canon and the doctrine of the Church of England is explained in Section 4 of the Church of England (Worship and Doctrine) Measure 1974. Section 4(1) provides that,

“Every Canon...shall be such as in the opinion of the General Synod is neither contrary to, nor indicative of any departure from, the doctrine of the Church of England in any essential matter.”

The principle is underlined by Section 4(2)

“The final approval by the General Synod of any such Canon...shall conclusively determine that the Synod is of such opinion as aforesaid with respect to the matter so approved.”

Thus it is necessary for this court to have regard to Canon C2.1 both as binding in law and as consistent with the doctrine of the Church of England. It is common knowledge that the decision to consecrate women as bishops was the subject of prolonged and anxious debate in the General Synod, during which the meaning and effect of both Scripture and Tradition were the subject of close scrutiny. In the result the General Synod adopted a position contrary to Mr Holland’s theological views. Its conclusion, reflected in its final approval of Canon C2.1 as it now stands, requires me to determine that there is no legal or doctrinal impediment preventing the election of the Right Reverend Sarah Mullally from being confirmed.

It should be added that a further difficulty faces Mr Holland in pursuing his objection. Bishop Mullally has already been admitted to episcopal orders and is serving as a suffragan bishop. An objection to her qualification for service in a diocesan post appears doomed to failure, since as a matter of fact she has for some time been discharging episcopal functions following her lawful consecration. I have given careful consideration to Mr Holland’s written and oral submissions, which he has presented in a concise and effective manner. Notwithstanding the skilful presentation of his arguments, I am satisfied that they have no foundation in law. Accordingly I am bound to dismiss his objection, and direct that he is debarred from pursuing further the protest that he has made to this court.
