<text>This document is a novelty. Traditionally, the Sovereign would delegate this power anew for each investiture (cf. Royal Warrants for Letters Patent granting the power to the Queen Mother and the Prince of Wales). However, this instrument sought to give certain members of the Royal Family standing permission to confer the honor of knighthood in the Monarch's absence.

The language is reminiscent of the older instruments with the main change being that it is addressed to multiple members of the Royal Family and it is not tied to a specific investiture.

These Letters Patent appear to remain in force despite the Queen's death. At any rate, they have not been reissued under King Charles III even though several of the individuals named in this instruments would no longer be suitable stand-ins for the Sovereign.

There are a few stylistic issues. The Duke of Edinburgh's role as Grand Master of the Order of the British Empire and the Princess Royal's role as Grand Master of the Royal Victorian Order are omitted (conversely, the Prince of Wales' role as Great Master of the Order of the Bath is mentioned). "The Princess Royal" is also placed before Princess Anne's names when it should appear after.</text>

<text>This is a novel instrument and so perhaps it is unsurprising that it displays a number of drafting peculiarities:

While it recites the Letters Patent of Queen Victoria and King George V, it makes no mention of the Letters Patent of King George VI which granted the style of "Royal Highness" and titular dignity of "Prince" to the children of Princess Elizabeth.

There is no greeting clause. One would expect it to be addressed "to all to whom these Presents shall come."

There is no direction to the Earl Marshal to record the Letters Patent in the College of Arms.

These Letters Patent make liberal use of punctuation even though it traditionally omitted from these types of instrument.

The incipit of the first substantive clause is "AND WHEREAS" when it would normally be "WHEREAS".

Andrew's surname is given as "Mountbatten Windsor" even though Queen Elizabeth II's 1960 declaration used a hyphen.

Normally, a person's full name is used in these types of instrument, but Andrew's middle names have been omitted. There is also no honorific mode of address, though this may have been a deliberate omission since the traditional forms would be an awkward fit.

The Warrant is not addressed to anyone. Since this is a command to the Justice Secretary, one would expect it to be addressed to him or perhaps "to all to whom these presents shall come," but neither approach is used.

"Greetings" has also been omitted after the first paragraph.

There's no attempt to cite any authority for removing the Duke of York. Since this was done under the Royal Prerogative, one would normally expect to see language like this: "Know ye therefore that in the exercise of Our Royal Prerogative We do hereby..."

Referring to Andrew as "the Duke of York" is unusual, as traditionally a royal duke would be referred to as "Our Most dear and entirely beloved Brother." But its omission may have been a deliberate choice rather than an oversight.

In your letter of the 8th September, you mention the high cost of insertions in the Gazettes. Is there here another minor economy to be effected? I understand that the text of Letters Patent is repeated verbatim in each Gazette. Is this necessary? For example, would it be good enough, in our case, if the entry were on these lines:

“Letters Patent appointing A., B and C as Counsellors of State were issued under the Great Seal on … September 1980”?

There may be some law of the Medes and the Persians that forbids this; but it should save a little money.

Thank you for your letter of the 4th September about Letters Patent appointing Counsellors of State.

I confirm that the sealed Letters Patent for this purpose which you send us are not issued to anybody but are simply kept in a cupboard here. They are therefore as you say in a class of their own and I entirely support your suggestion that they should in future be produced in a more economical form.

It is quite stimulating to find the extent to which, under current pressures, one can save money by cutting out time-honoured practices for which, on enquiry, there proves to be little or no justification! I have myself already identified several such practices here, notably in regard to the appallingly expensive business of publication in the Gazettes.

Yours ever,

4th September 1980

LETTERS PATENT

It has been suggested to me that we ought to reconsider the practice whereby Letters Patent appointing Counsellors of State are engrossed on vellum and have the Great Seal affixed to them.

The point is that each time this is done, it costs about £390. The procedure, as you know, is for a Warrant to be typed on good quality paper, to be submitted for the Queen’s signature and, when the Warrant duly signed is returned, the Letters Patent are engrossed on vellum at a cost of £15 a sheet, and subsequently put in a leather pouch which costs £10; the engrossing fee is £50. When the Letters Patent have passed the Great Seal, notice of that fact is reported in the three Gazettes at a cost of £95 for each insertion. As I understand it, the Letters Patent are then sent to you and remain in the Privy Council Office until, presumably, the time comes for them to be sent to the Public Record Office.

The suggestion is that we could make a minor economy by substituting, for engrossment on vellum, typescript on good quality paper and by using the Wafer Seal. This suggestion may well be worth pursuing if (as I believe to be the case) the Letters Patent are never publicly exhibited or sent to (or retained by) any of the Counsellors of State named in them. On that assumption, they seem to fall into a quite different category from Letters Patent creating a peerage, appointing to a great office of State, or embodying a Royal Charter – each of which is cherished and proudly exhibited by its recipients.

However, before I take the matter any further, I would be grateful for your views.
