LORD GREAT CHAMBERLAIN

Derek Mitchell mentioned to me a little while ago that you would be grateful at No. 10 to be kept informed privately of what was going on here, and of any points of interest or difficulty that might arise.

I am, therefore, sending you, for your private information, a copy of a note which I have done for the Lords’ Ministers on the next steps to be taken.

What I say in this note rests, as you will see, on a number of assumptions in regard to Government intentions and also in regard to the juridical aspects of the problem which are not at all straightforward.

The main point which I have been making privately to Ministers is that when the Government have brought their present round of consultations to a conclusion and have made up their collective mind on what they propose to do, they must put their proposals to the House of Lords in the form either of an oral or a written statement (preferably, I would say, in that of a White Paper), give the House time to digest the proposals and then put down a Motion asking for the House’s approval. There is a certain amount of reluctance here to accept this advice, but I am firmly of the opinion (which I believe George Coldstream agrees) that they will store up great trouble for themselves if they try and get away with anything less than the formal approval of the House of proposals that the House has had fully explained to it. I see no reason at all why this approval should not be forthcoming.

But before they get to this final stage, the Government must have made sure that the Queen approves and is ready to sign an instrument modifying the powers of the Lord Great Chamberlain and transferring all the prerogative functions (i.e. the functions which he exercises in virtue of his office as Lord Great Chamberlain, whatever they may be), except the ceremonial functions, to the Speakers of the two Houses.

Page 2

(This assumes that it is accepted that the Queen can validly take such action and that the transfer does not require legislation).

In this connection I have assumed that the Queen will not sign the instrument until both Houses have agreed to the Government’s proposals. But the relations with the Queen and the various processes of informal and formal approval are, of course, a matter for the Government not for the House of Lords.

Then there is also the matter of consultation with Lord Cholmondeley, with his heirs, and with the other families who have a hereditary interest in the office. Here it would seem to be prudent and courteous for the Government, before they put their proposals to the two Houses, to explain them to the interested parties and to seek their approval, not of what the Government propose to do but of the way in which they propose to proceed. This would diminish the risk of any of the interested parties subsequently claiming that they had been deprived of their rights by illegal means.

I hope this letter may help to keep you in the picture.

Forgive me if I appear to intrude upon Government business. I do so only in so far as the Government proposals affect the House of Lords.

My dear Lascelles,

Yesterday morning The Queen sent for me just before the Council at Clarence House and asked me to tell Her Majesty how the ceremony of kissing hands was performed and I explained the practice to The Queen.

The ceremony is of course entirely for Her Majesty’s Pleasure, but it occurs to me that The Queen might wish to determine what the procedure should be during Her Reign. I therefore make the following suggestions for consideration:—

When the Privy Counsellor (or Minister) who is to kiss hands kneels on the footstool The Queen should proffer Her right hand, palm downwards, with fingers lightly closed, to the person who is to kiss hands. He will extend his right hand, palm upwards, and take The Queen’s hand lightly in his and kiss it. His lips should no more than just touch Her Majesty’s hand.

Perhaps you would in due course let me know Her Majesty’s Pleasure so that when in future I rehearse new Privy Counsellors in the ceremonial of a Council I may do all I can to secure that The Queen’s wishes are followed.

Date 2 August 1988

Dear Mr Williams

£1 SILVER COIN: ROYAL PROCLAMATION

As you may know, we have run into a problem with the 1988 £1 silver coin: the coin has been issued without a Royal Proclamation.

Before any new UK coin is issued a Proclamation needs to be signed by the Queen (or her representative); once signed the Proclamation is reproduced in the London, Edinburgh and Belfast Gazettes. While the Treasury is willing to assist in the executive side of this work (essentially consulting Treasury Solicitor and liaising with the Privy Council Office) the responsibility for ensuring a Proclamation has been made, before coins are issued, rests with the Royal Mint.

I understand that the 1988 £1 silver coin was first issued on 21 April 1988. Yet it was not until the last week in May that the Royal Mint made us aware of its existence. A Proclamation is required for this coin (I have sent a draft to Linda Viner). This will be presented to the next Privy Council meeting in October. But we are clearly in an awkward position. We will have to explain the background to the Privy Council in such a way as to ensure that there was no question of us deliberately misleading them. And there is the awkwardness of appearing to present the Queen with a fait accompli.

There are legal aspects too. Legally the coins which have so far been issued bearing the new design are not legal tender. Treasury Solicitor inform us that there is no question of the Proclamation having retrospective effect. It would be wise therefore to issue no more of these particular coins until after the Proclamation is signed in October.

Page 2

It is most important that we avoid this kind of oversight in the future. I should be grateful if you would institute a formal set of arrangements for notifying us of all new UK coins well before they are issued (together with their planned issue dates), and make sure that all the relevant staff at the Mint are aware of the arrangements.

Yours sincerely,
(Sgd.) George Haydon
G C HAYDON

The Master of Your Majesty’s Mint with his humble duty to Your Majesty begs leave to submit for Your gracious consideration photographs of the designs recommended for the obverse and reverse of gold coins to be issued in 1989.

Next year marks the 500th anniversary of the introduction of the gold sovereign in 1489, and it is proposed to commemorate this important occasion by the issue of half-sovereigns, sovereigns, two-pound pieces and five-pound pieces. All four coins will share the same design, which has been inspired by the design of the original 1489 sovereign of Henry VII.

The recommended obverse and reverse are the work of Mr Bernard Sindall. The obverse shows an enthroned portrait of Your Majesty, based on an approved design prepared for commemorative medals for Your Majesty’s Silver Jubilee in 1977. On the reverse is featured a crowned shield of Your Royal Arms, together with an appropriate inscription.

The coins will be struck for sale to collectors and are expected to become available early next summer.
