Ms Truss, with her humble duty to The King, wishes to refer to the terms of Statute XXXVI of the Order of the British Empire. Under this Statute the duty is laid upon the Prime Minister, in cases where it seems appropriate, to recommend the cancellation and annulment of an Appointment in this Order.

Paul Cahill was awarded an MBE in the New Year Honours List 2004.

Ms Truss, having considered the case in the light of general principles applied to forfeiture, feels bound to recommend for your Majesty's approval that the appointment of Mr Paul Cahill MBE should now be cancelled and annulled.
